DISCLAIMER, LIMITATION OF LIABILITY AND NOTICE
The services provided by Great Basin Internet Services, Inc. (GBIS) are provided without warranties of any kind. There are no guarantees that the use of these services will result in any benefits whatsoever to anyone. In no event will GBIS, or its principals, agents, stockholders, or employees be liable for any direct, indirect, incidental, or consequential damages, including but not limited to lost savings, lost profits, or lost opportunities, arising out of the use of, or the inability to use, these services, even if GBIS or its principals, agents, stockholders, or employees have been advised of the possibility of such damages, or for any claims by any other party.
GBIS is connected to the Internet worldwide computer network, and provides access to the Internet for its members. Virtually any type of information and material imaginable is available somewhere on the Internet, including some information and material which may be considered objectionable by some. GBIS acts strictly as a pathway to the Internet, and has no way of, and does not engage in the business of, controlling access to any part or subset of the Internet. Therefore, in no event will GBIS, or its principals, agents, stockholders or employees be liable to anyone or any entity as a result of any objectionable or inappropriate material, including but not limited to pornography, commercial or copyrighted software, or any other material that may have been retrieved from the Internet by way of the facilities of GBIS. Any person or entity who accesses the internet through GBIS does hereby agree to indemnify and hold harmless Great Basin Internet Services, and its principals, agents stockholders, employees, sysops, sysop assistants, and section leaders, from and against any liability to anyone or any entity that may arise due to such person's or entity's access of the internet through this information service.
POLICIES, TERMS AND CONDITIONS
Service is billed monthly in advance for all services and is due upon receipt. Accounts are in default if payment is not received within 30 days of invoice or statement date. Accounts in default may have their service interrupted. Such interruption does not relieve you of the obligation to pay the charges. A $10 reconnection fee will be imposed on accounts which are interrupted for failure to pay. If your payment method is returned to or refused to us, you are immediately in default. Returned checks are subject to a $25 returned check charge. Refused credit or debit card payments may have service immediately interrupted until alternative payment arrangements are met. Accounts in default are subject to an interest rate of 1.5 percent per month, or to the maximum allowable under state law on the outstanding balance. If you default you agree to pay GBIS its reasonable expenses, including attorney and collection fees, incurred in enforcing its rights under these Terms & Conditions. GBIS reserves the right to refuse service to anyone for any reason. Restoring service which had been terminated for nonpayment will be at the discretion of the GBIS billing department and may be subject to additional requirements including, but not limited to, reinstatement charges, prepayment or guaranteed methods of payment.
GBIS shall have the right to assign Service Agreement(s) in whole or in part without customer's consent. Service Agreement(s) may not be assigned by customer in whole or in part without the prior written consent of GBIS, which consent shall not be unreasonably withheld.
Customer support is available by telephone by calling 775.348.7299 or toll-free 888.477.7299. Customers experiencing difficulty are responsible to call for support. GBIS provides telephone technical support on a wide variety of Internet related problems. This is provided at no extra cost to the GBIS customer. When calling for support, please have available your login, basic system information including version of operating system being used, and phone number in case we must call back. If GBIS phone support is unable to resolve a problem an appointment may be made to bring your system to the GBIS offices for examination by our technical personnel.
GBIS provides a flat rate service. Charges are based on access availability not on usage. While we strive for 100 percent availability, problems can and do occur. Therefore, GBIS does not give credit for lack of usage due to any circumstance including, but not limited to, hardware malfunction (either the customer's or that of GBIS), interruption of Internet access caused by upstream providers, acts of God, natural disasters a lack of knowledge of Internet procedures, routine maintenance or other causes not listed above unless specified by overriding contractual arrangement.
If it is discovered that GBIS has made an error in establishing the account on our servers, credit up to the date the error is corrected will happily be given. If you suspect an error in the establishment of your account you are advised to contact Customer Support immediately.
CANCELLATION OF SERVICE
GBIS reserves the right to change rates and otherwise modify these Terms, Policies & Conditions either with or without notice.
THE FINE PRINT
These Policies Terms & Conditions supersede all previous representations, understanding or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of GBIS constitutes acceptance of these terms and conditions. Access to GBIS is dependent upon adherence to the GBIS Acceptable Use Policy and Content Guidelines. Failure to comply with GBIS policies may result in interruption of access and/or services.
